SECTION 1.120 APPEAL OF GEOGRAPHICAL TRANSFERS
Section 1.120 Appeal of Geographical
Transfers
a) In appeals to the Commission from permanent transfers from one
geographical area in the State to another, the employee shall have the
burden of introducing sufficient, competent, and credible evidence showing
that the transfer was unreasonable, unjust, or capricious and was not
a bona fide attempt to serve the best interests of the operating agency.
b) Under normal circumstances, a transfer of an employee for a period
in excess of 60 days will be considered a permanent transfer.
c) The appeal of geographical transfer shall be filed with the Commission
within 15 days of the date the employee is required to report to the
new location.
